Division 296 Strategic considerations for SMSF trustees and members

Division 296 is now law, and whilst we are not likely to see the first assessments being issued until 2028 there are elements that all SMSFs need to be contemplating for year one and strategic considerations that need to be weighed up at the member, fund, and beneficiary level. There will also be additional administration requirements that funds need to prepare for.

In this webinar, Tim Miller from Smarter SMSF will look at how the 30 June 2026 CGT cost base adjustment is a relevant discussion for all SMSFs, how Division 296 adds to the debate between reversionary and non-reversionary pensions and finally by extension, how death of an individual can lead to a triple threat death tax outcome that everyone should be trying to avoid, or at the very least minimise. For clients impacted by Div 296 it is not simply a case of take it out or leave it in, it’s about making decisions based on each individuals circumstances, and this concept will also be explored as part of the session.

Learning Outcomes
At the end of this webinar, participants will have an appreciation for:
·       The pros and cons of CGT cost base adjustments.
·       How the terms and conditions of existing or future pensions can impact who pays Div 296 and when.
·       The need to have estate planning conversations sooner rather than later.
·       How Div 296 will impact more than just members with more than $3 million.
