Webinar – Holding Business Real Property in an SMSF

SMSFs have long been promoted for their ability to hold business real property, either directly or indirectly via a company or trust.  Concessions apply to allow an SMSF to acquire from and lease to related parties where property satisfies the definition of business real property.  As such it’s important to understand the requirements of meeting the definition of business real property in relation to SMSFs for the purposes of the SIS Act.  

In this webinar, Tim Miller from Smarter SMSF will take a detailed look at the ATO’s ruling on business real property, SMSF ruling 2009/1, and will explore, amongst other things:

 
· the meaning of business real property within the SIS laws, including the two basic conditions that must be satisfied to hold it
· the business real property context in respect to the related party acquisition rules
· Primary production requirements
· Land development, vacant land and when is use of real property in a business
· the considerations when property doesn’t meet the definition
